Course Description

A lawyer’s skill in examining a witness or making the right objection is a key factor in the overall success of a case. Trial lawyers make common mistakes with witnesses throughout the journey of litigation. The objective of this course will examine witness mistakes made by lawyers when navigating a case from start to finish. Examples of pitfalls will be given (PowerPoint) of common mistakes made by lawyers with their witnesses. Also taught in this course are common mistakes made by opposing counsel’s witnesses. The course will cover witness mistakes during the pretrial phase (depositions and evidentiary hearings) through the trial phase (jury and non-jury). Common mistakes made by lawyers as to expert witnesses will also be discussed in this course.
